1. Acceptance of Terms

By accessing and using FileCurator, you accept and agree to be bound by the terms and provision of this agreement.

2. Service Description

FileCurator provides a secure file sharing platform that allows users to upload, store, and share files with others.

  • File Types: Images and videos only
  • File Size Limits: No per-file limit (limited by 250GB per transfer)
  • Transfer Limits: Maximum 250GB per transfer
  • Storage Capacity: 1TB total account storage (temporary)
  • File Retention: Files automatically deleted after 1-90 days (default 7 days, customizable based on your subscription)

3. User Accounts and Security Responsibilities

You must create an account to use our service. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Using strong passwords and keeping them secure
  • Notifying us immediately of any unauthorized access or security breaches
  • Ensuring your account information is accurate and up-to-date

4. Subscription, Billing and Pricing

Our service offers a 14-day free trial. A payment method is required to start your trial, but you will not be charged until the trial period ends. At the end of the trial period, you will be automatically charged for the Pro subscription unless you cancel before the trial ends. You may cancel at any time during the trial or after through your account settings or by contacting us. Cancellations take effect at the end of your current billing period. We do not refund any portion of fees already paid, including the unused part of a billing period after you cancel. If you are a consumer, your statutory rights regarding refunds are not affected by this clause.

Early Access Pricing Notice

If you subscribed during our early access period and received locked-in pricing, cancelling your subscription will result in the loss of your early access pricing. If you resubscribe later, you will be charged at the current standard rates.

Right to Cancel and Cooling-Off Period

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your subscription within 14 days of purchase without giving a reason. By subscribing and using the service, you give your express consent for us to begin providing the service immediately and you acknowledge that you will lose your right to cancel once the service has been fully performed during the 14-day period. If you cancel within 14 days and the service has already begun, you may be charged a proportionate amount for the service provided up to that point.

Payment Failures and Access Suspension

If a scheduled payment fails for any reason, your account will be immediately restricted to free-tier access until the outstanding balance is settled. Our payment provider will attempt to collect the payment over the following weeks using the payment method on file. You will receive email notifications about failed payments and can update your payment method at any time through your account settings. If all collection attempts fail, your subscription will be cancelled and your account will remain on the free tier.

Billing Disputes and Chargebacks

If you believe a charge is incorrect, please contact us at hello@filecurator.co.uk before disputing the charge with your bank or card provider. We will investigate and resolve legitimate billing errors promptly. Filing a chargeback or payment dispute with your bank for a valid charge without first contacting us may result in immediate suspension or termination of your account. We reserve the right to recover any costs incurred as a result of fraudulent or unwarranted chargebacks, including administrative fees.

Changes to Subscription Fees

We reserve the right to change subscription fees. Any fee changes will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle. Early access users with locked-in pricing will retain their pricing as long as their subscription remains active and in good standing.

5. File Storage, Expiration and Content Licensing

File retention depends on your subscription. On the Free plan, files are automatically deleted after 30 days. On the Pro plan, you can set retention between 1 and 90 days (default 7 days). Files are automatically and permanently deleted after the applicable retention period. We are not responsible for any data loss due to this automatic deletion policy.

Content Licensing: By uploading files to our service, you grant us a limited, non-exclusive license to:

  • Store and process your files for the purpose of providing our service
  • Generate previews and thumbnails where applicable
  • Enable sharing functionality as directed by you

This license terminates when your files are deleted or when you delete your account. You retain all ownership rights to your content.

6. Acceptable Use and Prohibited Content

FileCurator is for lawful, professional file sharing. You must not use the service to upload, store, or share:

  • Content that exploits or endangers minors, including child sexual abuse material (CSAM) or any depiction of child sexual abuse
  • Intimate or sexual imagery of any person without their consent (e.g. non-consensual distribution or revenge pornography)
  • Illegal content, including content that infringes copyright or violates applicable criminal or civil laws
  • Malicious software, viruses, or other harmful code
  • Content that harasses, threatens, or incites violence
  • Use that abuses or overloads our systems (e.g. automated scraping or bulk redistribution)

We may remove content and suspend or terminate accounts that violate this policy. If you believe content on our service violates these terms or the law, please report it to us at hello@filecurator.co.uk or via our contact form. We take reports seriously and will act in line with our legal obligations.

7. Fair Use Policy

Our service is designed for normal professional use by photographers, videographers, and creative professionals. To ensure service quality for all users, the following fair use guidelines apply:

Usage Guidelines

  • Storage: Service is intended for temporary file sharing, not long-term archival storage. Files are automatically deleted per your retention settings.
  • Video Transcoding: Fair use includes up to 100 hours of video transcoding per month. This covers typical professional workflows including wedding shoots, commercial projects, and portfolio deliveries.
  • Bandwidth: Reasonable download activity by legitimate recipients. Automated scraping, bulk downloading, or redistribution is prohibited.

Accounts with usage patterns significantly exceeding typical professional use (defined as more than 10 times the median usage across our user base) may be subject to review. In such cases, we will contact you to discuss your usage and may offer enterprise pricing options better suited to your needs.

Early access and promotional pricing applies to usage within these fair use guidelines. We reserve the right to adjust pricing for accounts with sustained extreme usage that materially exceeds fair use thresholds.

8. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Service Availability and Uptime

While we strive to provide reliable service, we do not guarantee uninterrupted availability. Our service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We shall not be liable for any downtime, service interruptions, or resulting inconvenience or loss.

10. Limitation of Liability

FileCurator shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. Our total liability to you for any claims arising from these terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may terminate or suspend your account at any time for violations of these terms, including but not limited to:

  • Breach of acceptable use or prohibited content policies
  • Persistent failure to pay subscription fees after reasonable collection attempts
  • Filing a fraudulent or unwarranted chargeback
  • Any activity we reasonably consider to be abusive or harmful to the service or other users

Where possible, we will notify you before taking action and give you a reasonable opportunity to remedy the issue. In cases of serious or repeated violations, we may act immediately without prior notice.

12. Governing Law and Dispute Resolution

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of our service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating any legal proceedings, we encourage you to contact us directly to resolve any disputes amicably.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website.
